SEKILAS TENTANG BUKU

Hadirnya buku ini merupakan sebuah jawaban dari kegelisahan yang muncul terkait peran ijtihad hakim Pengadilan Agama dalam melahirkan putusan yang memuat nilai-nila kemaslahatan. Dari beberapa penelurusan akademik masih ada putusan-putusan yang dianggap belum berpihak pada keadilan gender, sehingga perlu dipertanyakan mengenai argumen yang digunakan hakim dalam memutus suatu perkara. Setiap putusan hakim pasti akan berpijak pada nilai-nilai kemaslahatan, tapi maslahah seperti apa dan bagaimana yang menjadi acuan utama para hakim dalam membangun argumen tersebut.

Buku ini memaparkan bagaimana konsep maslahah digunakan sebagai argumen hakim Pengadilan Agama (PA) dalam perspektif gender pada putusan-putusan perkara perkawinan dan perceraian.

Dalam buku ini dijelaskan argumen hakim dalam memutus perkara, baru sebatas menerapkan konsep maslahah dengan analisis yang dekat (al-qaribah) dalam arti hanya untuk memenuhi permohonan pihak yang berperkara sepihak. Hakim belum sepenuhnya menggunakan analisis kemaslahatan yang lebih substansial (al-aqsa) sehingga berakibat munculnya putusan yang bias gender. 

Buku ini hadir sebagai upaya menegaskan pendapat Gustav Radbruch yang menggambarkan bahwa hukum yang baik bukan hanya jaminan hukum tetapi juga keadilan dan utilitasnya. Selain itu memperkuat argumen Weber yang mengatakan administrasi hukum pada Qadhi-Justice menjadikan hukum terikat oleh tradisi suci dan seringkali merupakan penafsiran yang sangat formalistik, bahkan Mark E. Cammack menyoroti hakim Pengadilan Agama sekarang terlihat hampir secara eksklusif didasarkan pada otoritas hukum yang diterbitkan oleh negara. Lebih jauh buku ini mengungkapkan sisi yang berbeda dengan hasil penelitian Stijn Cornelis Van Huis yang menyatakan bahwa Pengadilan Agama di Indonesia telah responsif terhadap hak-hak perempuan.
