SEKILAS TENTANG BUKU

Hukum perkawinan di Indonesia secara normatif telah diamalkan dan dilaksanakan sejak Islam hadir di Indonesia. Seiring dengan perubahan zaman, hukum perkawinan di Indonesia mengalami perubahan yang signifikan hingga menjadi bagian hukum materil dalam tata hukum Indonesia. Hal ini adalah keinginan dari masyarakat supaya hukum perkawinan disesuaikan dengan kondisi dan keadaan Indonesia yang semakin maju dan modern. Dalam kenyataan, hukum perkawinan yang selama ini dipandang sebagai hukum yang hidup di tengah masyarakat Islam Indonesia (the living law), akhirnya memiliki legitimasi yang kuat dari pemerintah dengan diundangkan dalam peraturan negara RI, seperti Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Peraturan Pemerintah Nomor 9 Tahun 1975 tentang Pelaksanaan UU. No. 1/1974 dan Kompilasi Hukum Islam di Indonesia yang berlaku khusus untuk umat Islam di Indonesia, berdasarkan INPRES No. 1 Tahun 1991.

Buku Hukum Perkawinan di Indonesia yang ada di tangan pembaca ini diramu dari berbagai literatur dan ditambah dengan sumber lain, baik dari perundang-undangan mapun kitab/buku fiqh munakahat, baik klasik maupun kontemporer. Penulis buku ini salah seorang pakar hukum keluarga, di mana beliau sudah mengasuh mata kuliah hukum perkawinan ini sejak mata kuliah ini menjadi bagian dari kurikulum Fakultas Syari’ah UIN STS Jambi. Oleh karena itu, buku ini pantas dimiliki mahasiswa UIN, IAIN, STAIN, STAIS dan masyarakat umum yang berminat untuk menggali dan memahami hukum perkawinan di Indonesia.
